IBSTAGE TERMS & CONDITIONS AGREEMENT

By signing this Agreement, I/WE/YOU are, or may be, giving up important legal rights. Before signing this Agreement, You should carefully read this Agreement in order to fully understand the legal rights that You are, or may be, giving up.
When you submit your registration through the IBStage website or through any kind of IBStage communication channel, including the paper forms, you declare that all forms, applications and information provided are accurate and true and can be verified and demonstrated at any time.
You agree to make payments relating to your registration in compliance with the Terms & Conditions established by IBStage as detailed below.
In consideration for the student being permitted to participate in the IBStage Program 2017 (hereinafter “IBStage”), I (parent, guardian) together with the student, if the student is of legal age to execute a binding agreement, (hereinafter referred to as “I/we”), hereby agree, and represent as follows: ­

FEES FOR THE DIFFERENT TYPES OF REGISTRATION WILL CHANGE AFTER MAY 1, 2017.

I)  FEES & PAYMENTS

A.  AUDITIONS FEES

1.)     Audition Fee35 euro plus a Registration and Payment Processing Fees of 4 euro.
2.)     Audition Fee –  Not Refundable.
3.)     The Audition Fee should be paid via PayPal/Credit Card at the time of Registration.
4.)     Payment of the Audition Fee implies that the participant irrevocably ACCEPTS the result of the Audition, both if this implies the non-acceptance of the student on the 3-week Program (they can opt for the 1- or 2-week Programs) and if it affects Group Assignation.

 

 

 


 
B.   THREE WEEKS PROGRAM FEES
 
Registration in the Three-Weeks Program implies the contracting and acceptance of the payment of the corresponding fees for those goods and services implicit and necessary for the proper development of the program’s activities. IBStage offers participants other goods/services whose contracting by the student is voluntary.
 
 
STANDARD PRICE (1.425 EURO) registering before May 1, 2017.
A “Registration & Payment Processing Fee” of 5% from the Total Amount of Registration will be applied.
Payment must be made as follow:
 
First Payment €500 (Deposit)
To be done at the point of formalizing your Online Registration.
Accepted Payments Methods: Payment can be made only by PayPal or Credit Cards.
 
Second Payment €925 
To be done in a maximum of 40 days after the registration and before June 15, 2017.
Accepted Payments Methods: Wire Transfer, PayPal and Credit Cards.
 
Third Payment €X (pending amount if any)
To be made before July 15, 2017
Accepted Payments Methods: Wire Transfer, PayPal and Credit Cards.
Payments made by Bank Transfer
Bank Transfer is allowed only for the 2nd and 3rd payment.

EARLY PRICE (1.325 EURO) registering before February 15, 2017.
A “Registration & Payment Processing Fee” of 5% from the Total Amount of Registration will be applied.
Payment must be made as follow:
ONE TIME PAYMENT SOLUTION
The total Amount of Registration to be paid when registering and the accepted payment methods are by PayPal and Credit Cards.
For this Type of Registration, Fractionated Payments are not accepted.
This type of Registration is available for only 20 spots, and will be applied the First – Come, First – Served Base.
Are not entitled for this option those who received a scholarship, a discount, or any other type of financial aid.
 
LATE PRICE (1.500 EURO) registering after May 1, 2017.
A “Registration & Payment Processing Fee” of 5% from the Total Amount of Registration will be applied.
Payment must be made as follow:
First Payment €500 (Deposit) 
To be made at the point of formalizing your Online Registration.
Accepted Payments Methods: Payment can be made only by Paypal or Credit Cards.
Second Payment €1000 
To be done in a maximum of 40 days after the registration and before July 15, 2017.
Accepted Payments Methods: Wire Transfer, PayPal and Credit Cards.
Third Payment €X (pending amount if any)
To be done before July 15, 2017.

Delay in making Payments
A delay in paying within the established periods will incur a surcharge of 5% of the amount to be paid from the day following the end of the period, and a surcharge of 10% if the delay is more than 2 weeks.
Scholarships, Promotions & Offers
If there are any promotions or offers, the Payments will be regulated by the Promotion/Offer Terms & Conditions.

 

 

 


 
C.   TWO WEEKS PROGRAM FEES
 
Registration in the Two-Week Program implies the contracting and acceptance of the payment of the corresponding fees for those goods and services implicit and necessary for the proper development of the program’s activities. IBStage offers participants other goods/services whose contracting by the student is voluntary.
 
STANDARD PRICE (875 EURO) registering before May 1, 2017.
A “Registration & Payment Processing Fee” of 5% from the Total Amount of Registration will be applied.
Payment must be made as follow:
First Payment €500 (Deposit)
To be done at the point of formalizing your Online Registration.
Accepted Payments Methods: Payment can be made only by PayPal or Credit Cards.
Second Payment €375 
To be done in a maximum of 40 days after the registration and before June 15, 2017.
Accepted Payments Methods: Wire Transfer, PayPal and Credit Cards.
Third Payment €X (pending amount if any)
To be made before July 15, 2017

D)   ONE WEEK PROGRAM FEE

IBStage offers participants other goods/services whose contracting by the student is voluntary.
 
STANDARD PRICE (550 EURO) registering before May 1, 2017.
A “Registration & Payment Processing Fee” of 5% from the Total Amount of Registration will be applied.
Payment must be made as follow:
ONE TIME PAYMENT SOLUTION (550 EURO)
The total Amount of Registration to be paid when registering and the accepted payment methods are by PayPal and Credit Cards.
For this Type of Registration, Fractionated Payments are not accepted.
 
LATE PRICE (600 EURO) registering after May 1, 2017.
A “Registration & Payment Processing Fee” of 5% from the Total Amount of Registration will be applied.

E.   FEES FOR OBLIGATORY AND VOLUNTARY SERVICES/GOODS ASSIGNED BY THE PROGRAMS
 
Registration on the Programs implies the contracting and acceptance of the payment of the corresponding fees for those goods and services implicit and necessary for the proper development of the program’s activities. In addition, IBStage offers participants other goods/services whose contracting by the student is voluntary.
The provision of these services or the acquisition of these goods requires the payment of the corresponding fees, and it’s obligatory to contract some of them at the point of formalizing the Online Registration. Those services and/or goods that are voluntary may be contracted at the point of Registration or opted for once the program has started; IBStage may modify the corresponding fees without the need for prior warning.
The fees for obligatory goods/services gala uniform except Platter Tutu and black skirt, medical insurance, civil insurance and Gala Dinner on September 2, 2017 – are included in the Matriculation fee.
Other services that IBStage will provide on a voluntary basis are the following:
 
  • Canteen 3 weeks: €130.50 (No Reimbursements)
  • Canteen 2 weeks: €95.70 (No Reimbursements)
  • Canteen 1 week: €43.50 (No Reimbursements)
  • Rehearsal Platter Tutu: €105
  • Rent of Rehearsal Platter Tutu: €35
  • 3 day set menu Theater (sandwich, water and fruit): €6,50 (No Reimbursements)
  • Beach Party: €12
  • Disco Party: €5
  • Limited Edition T-shirts 2016 (final stock available): €25
  • Limited Edition T-shirts 2017: €25
  • IBStage bag: €15
  • DVD: €35
  • 2-journey transfer (Hotel-El Prat Airport): €39
  • 1-journey transfer: €20
  • Medical Insurance Plus: €100 (includes health care in the event of common illness during your stay on the Program)
Female participants to the 3-Weeks Program who dance in the Ibstage Galas are not obliged to purchase or rent the IBStage tutus, but IBStage reserves the right to not accept models that don’t meet the necessary measurements, layers or requirements.
 
F.   SCHOLARSHIPS, OFFERS & PROMOTIONS
 
1.) Students who receive a Full Scholarship/Partial Scholarship are not eligible for any type of reimbursement even if they are ill or they suffered a physical or psychical injury.
2.) The Offers and Promotions made by IBStage cannot be discussed by the students who are registered to IBStage. IBStage is free to change the prices of their services at any time and without previous notification.
3.) If a student registered to IBStage Program with a “X Price”, and this price is higher than a Price offered in an IBStage Promotion, the student is not eligible to ask for a discount in the Registration Fees.
4.) Participants who receive several scholarships for IBStage have to accept the first scholarship that he/she received.
5.) Scholarships are not cumulative.
6.) Participants who are registered with IBStage and receive a scholarship after his /her registration with IBStage, are not eligible to apply for the scholarship.
7.) IBStage may offer grants, discounts or promotions via the Web at any time on the basis of economic criteria or talent and contingent on the funds available for such a purpose, national or international contests in which IBStage has a presence as well as in the event of considerable volume in the numbers of registrations
 
G.   ACCOMMODATION FEES
 
Ibstage is not responsible for the Accommodation Services. Ibstage is only acting as a third part between the participant and the hotel in order to obtain the best low fare for the participant.
  • Reimbursements for any type of accommodation booked through IBStage for student, his/her family or friends, are not accepted.
2.)      Students who booked their accommodation using the online registration form or by contacting one of our assistants (by phone or by email) have to pay in full for the accommodation even if they don’t want to stay any more in our partner hotel or they have changed their mind.
3.)      It’s very important to understand that IBStage contracts and pays for a number of rooms from its hotel partner, and if you book this service it’s mandatory to pay for it even if you don’t come to IBStage. Non-payment of this service will incur in a civil process in order to recover the money.
4.)      The prices offered for Accommodation may change daily as our booking system is connected with the booking system of our partner hotel (we guarantee that you will have the lowest price always).
5.)      A Booking Fee of 20 euro (Booking & Touristic Tax) is required in order to book your accommodation with us.
6.)      Any type of error made when you book your accommodation with us can incur penalties or surcharges.
 
H    TRANSPORTATION/TRANSFER FEES
 
Reimbursements for any kind of Transportation booked through IBStage, for student, his/her family or friends, are not accepted.
 
II)  REIMBURSEMENTS
 All the participants to Ibstage have to acomplish with the following terms and conditions in order to be reimbursed.
  • Reimbursements are allowed in case of illness or injuries and only if the student presents 2 different medical certificates from 2 different Specialized Physicians(It’s very important to respect this condition). Certificates issued by a Physiotherapist are Not Accepted.
  • The Certificates have to mention clearly that the student can notattend the IBStage Program, also have to specify the type of injury or illness, the date of issue, the signaturename and Collegiate number of the Doctor and the Authority Centre where the certificate was issued.
  • Any other type of cancellation/withdrawal that isn’t a health problem,  before or while the program is taking place doesn’t entitle the student to the reimbursement of any fee.
  • The Maximum Amount to be reimbursed will be600 euro (3Week Program), 385 euro (2Week Program), 200 euro (1Week Program) if the cancellation/withdrawal is made before of August 14, 2017;
  • if the cancellation/withdrawal is made after August 14, 2017, the maximum amount to be reimbursed will be calculated by the IBStage Team as follow:
THREE WEEKS PROGRAM
            €30 x number of days left to finish the program.
TWO WEEKS PROGRAM
            €35 x number of days left to finish the program.
THREE WEEK PROGRAM
            €40 x number of days left to finish the program.
No Reimbursements will be done for the following services: Transportation, Accommodation, Lunch/Canteen, Audition, Tutu Rent.
Reimbursements will be done after October 15, 2017.
 
III)  PROGRAM’S TERMS & CONDITIONS
1.)      Students’ Requests for a Group change are Not Accepted. Groups are made and organized by the IBStage Staff, and IBStage is not obliged to give information about the process of the groups’ administration.
IBStage will calculate the Final Grade of the auditioned student on the basis of a equalitarian formula for all candidates, and that is calculated with a weighting that will take as Variables the Age of the student and the Total Score obtained for each one of the assessment criteria. IBStage reserves the right to any Exception with respect to the final Group assignment. Attainment of the Final Grade depends on an unequivocal criterion by the jury that is expressly selected by IBStage. The result offered by this jury is irrevocable, and no claim or request for reconsideration by any participant in relation to the assigned group will be allowed. In addition, students who don’t accept this result may leave the program. No refund will be given for leaving the program for this reason.
2.)      Plan of Studies – Student cannot request information about the process of creation of the Plan of Studies. Students are not allowed to request the study of a special subject and it’s also not permitted to request the elimination or introduction of subjects in the program. (Example: Student A asks the artistic director why they can’t do the Pas de Deux Class. The Director gives a plausible reason for why the student can’t join that class. Even so the student insists on joining the Pas de Deux Class, threatening that if they don’t take part in the Pas de Deux class they will leave the program and ask for their money back.) This kind of request is not accepted by IBStage and the student may leave the program. No Reimbursements will be accepted.
3.)      Other Organization Matters – Students accept that they will follow, respect and accept all the rules, conditions, plan education, guidelines, procedures, and other organizational matters established and adopted by IBStage. Breaking or non-acceptance of this clause is punished with the expulsion of the student from the Program, with the consequence of loosing all the paid fees and also with consequence to be banished for future editions.
4.)      Merchandising and other Services – All the merchandising and services offered by IBStage can be sold at different fees. No notification will be made when prices are changed.
5.)       Obligatory complementary documentation – Students must provide all the required documentation once the Online Registration is formalized. Once the Registration Form has been completed, the participant or guardians (in the case of under-18s) must provide the certificates that are specified, sending them to the indicated e-mail address and also bring the originals to the Check-in that will take place in the venue where the course is held. In addition, the student should bring the other personal documentation that is required and must be attached to the Form: official identity documents for the student and for the guardian (for under-18s), Family Book (under-18s), photograph and other items that may be required in the Form and which, in the event that they are not presented, could lead to the the non-formalization of the Registration with the consequences that are established in these Terms and Conditions.
 
IV)  CODE OF CONDUCT
Participants (Students) of IBStage Program are expected to assume responsibility for their behavior and conduct. Participants (Students) are expected to acquaint themselves with and abide by the rules, procedures and standards of conduct established by IBStage, and which may be modified during the season. A dancer whose conduct is not consistent with these standards and rules will be subject to disciplinary action, up to and including dismissal from IBStage Program without any type of Reimbursement.
Expulsion from the Program for those participants who were awarded with a Full/Partial Scholarship or Discount leads to the payment in full of all  Program Fees.
The standards of conduct include but are not limited solely to the following prohibitions (with expulsion or other disciplinary actions):
1.)      Use of, possession of, or impairment by illegal drugs and alcohol.
2.)      Use of tobacco products within or near the facilities.
3.)      Possession or use of weapons of any nature, fireworks, or an article that can be used in a dangerous or menacing manner;
4.)      Unexcused tardiness or absences from classes, rehearsals, performances, activities;
5.)      Threats, disruptive or disorderly conduct, including horseplay or hazing;
6.)      Injury to the persons or property of others, including but not limited to theft;
7.)      Creating a dangerous or hazardous condition;
8.)      Harassing, discriminatory or abusive conduct or language;
9.)      Violations of law, or of the safety rules, practices, or other policies procedures and rules of IBStage;
10.)     Permitting unauthorized visitors to the IBStage facilities;
11.)     Falsification of records or documents submitted to the Program; and
12.)     Failure to provide identification or comply with a staff member’s request.
13.)     Stealing is punishable with automatic expulsion from the program.
 
In addition, participants (students) must adhere to the following:
1.)      Students are required to attend all classes, rehearsals, and performances (in proper attire), and must notify a staff member or, if in class, a teacher, if they are not feeling well. Once a class has begun, the student will not be allowed to participate. The student must request permission to watch the class from the side. Students must report any accident or illness to a staff member.
2.)      Participants are expected to treat staff in a courteous and respectful manner at all times.
3.)      Do not bring any food inside the rehearsal studios.
4.)      Do not leave clothing, bottles, bags or any other personal items inside the studios.
5.)      Respect the schedules, which are pre-established and published on a daily basis.
6.)      Students who are under 18 may not leave the IBStage facilities or the hotel without the consent from an IBStage Adult Staff Member or written consent from their parent/guardian with a document brought expressly for this purpose and given to IBStage staff; it must include a telephone number, personal e-mail and a copy of the National ID card or equivalent of the signing parent/guardian.
7.)      Students who are younger than 18 may not leave the hotel from 10:30pm to 9:00am.
8.)      No damage to any furniture or material of any kind. Students will be held responsible for the costs of any damages.
9.)      Must have a mobile phone where they can be reached at all times.
 
V)  MEDICAL CONSENT & HEALTH STATUS
In consideration for the student being permitted to participate in the IBStage Program 2017 (hereinafter the “Program”), I (parent, guardian) together with the student, if the student is of legal age to execute a binding agreement, (hereinafter referred to as “I/we”), hereby agree, and represent as follows:
1.)      I/we are fully familiar with the intended activities and demands of a rigorous ballet/dance training program (intensive), including both the physical fitness expectations and the inherent and unavoidable risks of injury and harm, and I/we represent and warrant that the Student is able to participate fully in the Program’s activities, that no health professional has advised us of any risks or conditions that would limit or impede the Student’s full and safe participation, that I/we are not aware of any medical or other conditions which would limit the Student’s full and safe participation in the program, and that I/we understand and accept the inherent and unavoidable risks of injury and harm that may occur due to the Student’s participation in this Program. I/we agree further that if the Student sustains any injury or illness prior to the commencement of the Program, we shall advise IBStage promptly in writing so that an assessment can be made whether the Student can participate in the Program. I, therefore, consent to my child’s participation in the Program, and I further consent to my child’s participation in any other activity taken in connection with the Program.
2.)      I/we accept responsibility for medical expenses (including treatment, medical devices, emergency room visits, ambulances, and hospitalization, whether or not covered by insurance) for any injuries or illness that the Student may sustain or experience while participating in the Program; and warrant that (if applicable) the Student will provide proper identification and information to secure medical insurance coverage; and that I/we will promptly reimburse fully IBStage and/or any of its employees who advance the costs to secure medical treatment for the Student. I/we hereby grant permission for the Student to receive emergency medical treatment as appropriate during participation in the Program as may be authorized by an adult member of the Program Staff. I/we grant permission for the Student to receive onsite physical therapy treatment in some cases as authorized by an adult member of the Program Staff. I/we understand that if the Student has to take prescription medication or receive scheduled medical treatment, we shall notify the Program in writing and shall consult with the Program as to appropriate arrangements. It is not the responsibility of the Program to make such arrangement.
 
VI)  IMAGE RIGHTS
I/we understand and agree that during the course of the Program, the Student may be photographed and/or videotaped during the program activities or performances, and I/we grant IBStage the unrestricted right to use in any form the image, picture, likeness, voice, and/or name of the Student for all IBStage promotional materials including brochures, newspaper articles, books, and/or television and for commercial purposes. I/we agree to adhere to the policies therein.
 
VII)  INDEMNIFICATION
Furthermore , I/we hereby agree to indemnify and hold harmless IBStage and/or the agents, employees and directors of this institution (collectively, the “Indemnified Parties”) for any loss, claim, damage, suit, costs or expenses, including attorneys’ fees and court costs, resulting from or arising out of any injury to any person or damage to property, caused by or incurred by myself, my child and/or my ward, or whether caused in whole or in part by the negligence of the Indemnified Parties, incurred as a result of or during the PROGRAM or any activities in connection with the Program.
 
VIII)   ELEASE
By signing this Agreement, and in exchange for being able to participate in IBStage and use its Premises, You knowingly, willingly, absolutely, and unconditionally, release, remise, and forever discharge, indemnify and hold harmless IBStage and/or its affiliates and each of their current and former owners, directors, officers, and employees, as well as the predecessors, successors, assigns, affiliates, insurers, attorneys, representatives, fiduciaries and/or agents of each of them ( collectively the “Released Parties”) from ANY AND ALL liability of any type to You, and each of your trusts, heirs, executors, administrators, assigns, personal representatives, predecessors, successors, trustees, direct and indirect beneficiaries, attorneys and agents (collectively the “Releasing Parties”), from any and all actions or causes of action, suits, claims, complaints, contracts, liabilities, agreements, promises, torts, debts, damages, controversies, judgements, losses, and demands of every kind or nature whether existing, contingent, or future, known or unknown, suspected or unsuspected, whether in law or equity under the laws of any jurisdiction (“Claims”) (including without limitation any claims by the Negligence of IBStage, any of the other Released Parties, any other Guests or intruders, or otherwise) that relate to or arise out of  Your Participation in IBStage in any way, including without limitation any Claims that relate in any way to any injury or loss to You or your personal property.
In addition, in consideration for allowing You to enter and use the Premises of IBStage, You and the other Releasing Parties knowingly, willingly, absolutely, and unconditionally release, remise, and forever discharge, indemnify and hold harmless the Released Parties from any and all Claims that the Releasing Parties ever had or now have or may have against the Released Parties since the beginning of the World up to and including the date of this Agreement.
 
IX)  ASSUMPTION OF THE RISK OF PARTICIPATION & USE OF IBSTAGE PREMISES
By signing this Agreement, I/we agree to assume full responsibility for, and risk of, bodily injury, death or property damage to Me or my child (including without any limitation any injury, death or damage caused by the Negligence of IBStage, any of the other Released Parties, any other guests or intruders, or otherwise), which relate to or arise out of me or my child entry into or use of the IBStage Premises in any way. By signing this Agreement I/we acknowledge that the risks associated with entry into and use of the IBStage Premises may be both foreseen and unforeseen, and may include serious physical injury and/or death, and other personal and property damages, and I/we agree to assume all associated risks.
 
X)  CHOICE OF LAW & FORUM SELECTION
By signing this Agreement I/we agree, that any dispute, controversy or claim arising out of or relating to this Agreement or/and arising from the participation to Ibstage or/and arising from the entry or/and use of the Ibstage Premises, including but not limited to, claims, shall be interpreted in accordance with and governed exclusively by the laws of the Catalunya, without regard to conflict of laws principles that would cause the application of the laws of another jurisdiction, including any jurisdiction outside Catalunya and that I/we hereby knowingly waive and forgo any resort to the laws of any jurisdiction outside Catalunya in connection with the Claims, Indemnified Losses, and enforcement and interpretation of this Agreement regardless of where this Agreement has been signed by I/we or where I/we reside.
By signing this Agreement, I/we agree that any dispute, controversy or claim arising out of or relating to this  Agreement, shall be resolved exclusively and finally by binding arbitration in Barcelona, Catalunya, before one arbitrator, in accordance with the Commercial Arbitration Rules of the Catalonian Arbitration Laws.
The student and his/her parent or tutor, voluntarily signs this Agreement, and further agrees that no oral representations statements or inducement apart from the foregoing written agreement have been made.
I/WE HAVE READ AND UNDERSTAND AND AGREE TO THIS AGREEMENT.
THIS AGREEMENT IS ENTITLED TO BE VALID FROM THE MOMENT YOU FINISHED YOUR ONLINE REGISTRATION THROUGH OUR ONLINE REGISTRATION SYSTEM PROVIDED BY REGONLINE LTD., UNTIL  THE FINALISATION OF THE PROGRAM.
